Question: we live in clarksville TN and we were renting a place i was getting really sick and had to go to the emergancy. didnt no why. find out we have black mold growing in our house we tell our lanlord and he has people come out and they just cover it! okay i try and talk to him and hes yelling at me im telling him i cant live there its a health hasert for me.he says well mam u can leave but u will still pay rent. so me and my husband took our stuff ( didnt give our 30 days yet) and he find out we were moving to a diff place and he sends us an eviction letter. for nothing. and the last date we can b there is the 20th of oct. well my husband just went to go check the mail and get the trash and everything out of the house ansd they changed the locks to the house and threw everything away and locked our mail box! can they do this we have till the 20th!

a; you left based on a "constructive eviction." Make sure it is the cause of your hospital stay......... b; sue them for the rest of the prepaid rent and deposit and for the value of the thrown out goods. sorry for your loss; some LL's and their clerks are Jerks!

Her claim is with her estate. Period. Refer her to the county probate office. There is no administrator unless you choose to open an intestate estate.

The advise that they could go after your moms estate was probably the closest to what they could do, since you had no legal binding to her rental. The only thing you didn't address was when you went to her apartment was it to remove her belongings (such as furniture etc) Maybe this woman feels that your mom was worth more and is hoping to get something, especially if she never had asked for a deposit from your mom. She might have done this in good faith that your mom would pay rent and not leave the apartment damaged. If there were no personal properties or monies that can be collected upon then you probably can't be held liable. So wait and see what happens and if you get a letter from an attorney then seek legal advise on the issue. Good luck and even though you had a strained relationship with your mom I'm still sorry for your loss - - -

You cannot cry mold and break a lease and it is illegal to just stop paying rent. There is a proper legal procedure that needed to be followed in order for you to legally break your lease. Changing the locks on you and throwing out your stuff was also illegal. He needs to go through the proper eviction process and follow the abandoned property laws. If there was anything of value thrown out then you need to sue him for that amount.
